When purchasing a piece from the B at Home collection, there are points to be aware of so that your experience with us is fully-informed.
The following terms cover every detail from how we will provide our products to you and what to do if there is a problem, to the details of our returns policy and other important information of note.
Our Terms and Conditions are governed by and construed in accordance with the law
of England and Wales.
Why are these terms of use important?
These terms of use (together with the documents referred to in it form a binding agreement (“Agreement”) between you and Us, under which you may use this site and order associated products and services offered through this site or application (together the “Services”).
Do these terms apply to me?
By using our site and/or by placing an order with us, you are deemed to have read and understood these Terms and Conditions (“Terms”) and any and all policies referred to and incorporated herein. If there is anything that you don’t agree with or want to be committed to in these Terms and Conditions, then you should not use The Website or place any orders through it.
If you are under 18 years of age, please do not use the Site.
We ask that you read through to be sure that you’re comfortable and confident with the terms to which you’re agreeing before buying with us. If we have to contact you, we will do so by telephone or by writing to you at the email address you provided to us when you placed your order.
Placing an order
By making your order via our Site, you are making an offer to purchase goods which, if accepted by us, will result in a binding contract. Neither submitting an electronic order form or completing the checkout process constitutes our acceptance of your order.
Our acceptance of your order will take place when we email you to accept it, at which point a contract will come into existence between yourself and Rowen & Wren.
If we are unable to accept your order, we will inform you of this and will not charge you for the product. This might be because the product is out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the product, or because we are unable to meet a delivery deadline you have specified.
We will assign an order number to your order and inform you of it as the point of acceptance. It will help us if you can tell us the order number whenever you contact us about your order.
All payments are processed in Pounds Sterling. Details of the prices for the Products, and the procedures for payment and delivery are displayed on or through Our Website. The price of any Product is the price in force at the date and time of Your order. The price of any Product includes VAT but excludes any delivery charge.
We may make small changes to the appearance or specification of the Products supplied which do not materially affect their quality or function. Any accidental errors or omissions in any sales literature, quotation, price, acceptance of offer, invoice or other document or information made available by Us or on Our Website may be subject to correction without any liability on Our part. All statements given by Us as to the authenticity, description, age, or condition of Products constitute Our opinion or opinions of the producer only (except that this shall not operate so as to exclude any liability that We cannot exclude under applicable law).
You undertake that all details You provide to Us for the purpose of purchasing Products are correct, that the credit or debit card, or any electronic cash, which You use is Your own and that there are sufficient funds to cover the cost of any Products. We will charge credit or debit cards or Paypal account(s) prior to dispatch of the ordered Product(s) and may only dispatch the Product(s) once relevant funds
have cleared. We reserve the right to verify credit or debit card details and carry out such other fraud prevention or credit checks as may be appropriate prior to acceptance or dispatch of Your order. We may refuse to complete an order if We have reason to believe that card information or other personal
details You give Us are incorrect or have been supplied fraudulently.
Discount codes and offers cannot be redeemed on sale or promotional items. From time to time We will make promotional codes available. Only one code may be used per transaction. We will alert You to additional specific terms which apply to such promotional codes at the relevant time.
Cancellations
Should you have second thoughts on your order, please contact our customer care team as quickly as you can email us on info@burbeckathome.com. We will do everything we can to accommodate your request. However, if we have already dispatched your order unfortunately it is too late to be cancelled and you will need to make a return.
Delivery
At this time, we are unable to deliver outside of Mainland UK, which does not include UK Isle's, Scottish Highlands or Northern Ireland.
After an order is placed, we aim to ship it out within 5–10 working days. Following dispatch, your order will be delivered the following business day, or in the case of remote locations, within two to three business days.
If you ordered a pre-order item, please allow 5–10 working days for your order to arrive after the estimated shipping date. We will contact you closer to the time to confirm the precise delivery
date.
We will ship the entire order to you as soon as the pre-order item comes into stock if you ordered both in-stock and pre-order products.
Although we try to be as precise as possible when estimating delivery dates, there occasionally can be a small delay that is beyond our control. Any delays and anticipated shipping timeframes will always be updated on our website, and you may email our customer support team for the most recent delivery date.
Delivery fees:
Small Item Delivery - £6 inc VAT – for items that can be held in one hand (Accessories)
Please note: This delivery option is a doorstep delivery via DPD.
Standard
Delivery - £40 - £50 inc VAT – for items that can be held by one person in two hand (Stool, chairs, bedside tables) for items that require more then one person to lift (sideboards, dining tables)
Please note: This delivery option is to your room of choice (subject to access requirements) and assembly will not be included.
Whilst we endeavour to help in every way we can with your order, we aren’t able to accept any responsibility for failed deliveries, for example if you are not home during your confirmed delivery window or if an item doesn’t fit. Should this scenario occur, our delivery team will be required to take the piece back to our warehouse and may ask that you cover the delivery charge. If you are concerned about whether or not a product will be deliverable to your home, you contact our care team who will be able to advise how you can check before placing your order.
If you decide to give us the instruction of leaving it in a safe place or with a neighbour, the responsibility for the safety of your parcel lies with you.
If our delivery of your product is delayed by an event outside our control then we will contact you as soon as possible to let you know and we will take reasonable steps to reduce the delay.
We will not be liable for delays caused by an event which is outside of our control, but if there is a risk of substantial delay you may contact us to let us know you will not be going ahead with your order and you will receive a refund for any products you have paid for but not received.
A product will be your responsibility from the time we deliver the product to the address you gave us, and you own that product once we have received payment in
full.
Warranty
1) We warrant that on delivery the Products shall:
a. conform in all material respects with their description;
b. be free from material defects in design, material and workmanship; and
c. be fit for any purpose held out by Us on Our Website.
2) If You give Us notice in writing within one year of delivery that
a. some or all of the Products do not comply with the warranty set out above in point 1,
b. We are given a reasonable opportunity of examining such Products; and
c. You (if asked to do so by Us) return such Products to Our place of business at Your cost,
d. We shall, at Our option, repair or replace the defective Products, or refund the price of the defective Products in full.
3) We shall not be liable for Products' failure to comply with the warranty set out at point 1 in any of the following events:
a. You make any further use of such Products after giving notice in accordance with point 1
b. the defect arises because You failed to follow Our oral or written instructions as to the storage, commissioning, installation, use and maintenance of the Products or (if there are none) good trade practice regarding the same;
c. You alter or repair such Products without Our written consent;
d. the defect arises as a result of fair wear and tear, wilful damage, negligence, or abnormal storage or working conditions; or
e. the Products differ from their description as a result of changes made to ensure they comply with applicable statutory or regulatory requirements.
f. Except as provided herein, We shall have no liability to You in respect of the Products' failure to comply with the warranty set out at 3.7.
g. The terms implied by sections 13 to 15 of the Sale of Goods Act 1979 are, to the fullest extent permitted by law, excluded from these Terms.
h. These Terms shall apply to any repaired or replacement Products supplied by Us.
Returns & exchange
If you wish to return an item - Within 14 days of the customer's order delivery, we happily accept returns. Your item must be unused and in the original packing, in the same condition that you received it, in order for you to be eligible for a return.
Please allow up to five business days to handle returns after we receive them.
Appreciating natural materials
The images of the pieces on our site are for illustrative purposes only. Although we have made every effort to display the colours accurately, we cannot guarantee that a device’s display of the colours accurately reflects the colour of the pieces. Your piece may vary slightly from those images.
Any packaging may also be different from the packaging images shown on our site.
Modifications to the website/product lines
We reserve the right to alter or suspend any aspect of Our Website or the content or discontinue Product lines available through it, including Your access to it. Unless stated otherwise, any new features including new content, and/or the sale of new Products shall be subject to these Terms.
Whilst We will endeavour to make sure Products are in stock, all advertised Products are made available for purchase subject to availability and We cannot be liable if a particular Product is not available. We will endeavour to inform You by email if any Product You have ordered is no longer available and refund any money You have previously paid.
Information you provide
The following applies to any information You provide to Us, for example during any registration or ordering process. You must also read Our Privacy Policy which contains important information about the use of Your Personal Information and other information regarding Your Privacy.
You authorise Us to use, store or otherwise process any personal information which relates to and identifies You, including but not limited to Your name and address, to the extent reasonably
necessary to provide the services which are available through Our Website by Us or Our sub-contractors. If You obtain or choose to buy Products through Our Website then We may collect information about Your buying behaviour and if You send Us personal correspondence such as e-mails or letters then We may collect this information into a file specific to You. All such information collected by Us shall be referred to in these Terms as "Personal Information";
You must ensure that the Personal Information You provide is accurate and complete and that all ordering or registration details (where applicable) contain Your correct name, address and other requested details.

You are solely responsible in all respects for all use of and for protecting the confidentiality of any username and password that may be given to You or selected by You for use on Our Website. Causes beyond Control
Neither you nor B at Home will be held liable for any failure to perform any obligation to the other due to causes beyond Your or Our respective reasonable control.
No Waiver
If you breach these Terms and We take no action against You, We will still be entitled to enforce Our rights and remedies in any other situation where You breach these Terms.
Our liability
If we fail to comply with these terms, we are responsible for loss or damage you suffer that is a foreseeable result of us breaking our contract with you or our failing to use reasonable care and skill, but we are not responsible for any loss or damage that is not foreseeable.
Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen.
We do not exclude or limit in any way our liability to you where it would be unlawful to do so.
This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors; for fraud or fraudulent misrepresentation; for breach of your legal rights in relation to the products; and for defective products under the Consumer Protection Act 1987.
We only supply our products for domestic and private use. If you use the products for any commercial, business or resale purpose we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date.
These terms are governed by English law and you can bring legal proceedings in respect of the products in the English courts.
If you live in Scotland you can bring legal proceedings in respect of the products in either the Scottish or the English courts.
If you live in Northern Ireland you can bring legal proceedings in respect of the products in either the Northern Irish or the English courts.
Intellectual property rights
All copyright, trademarks and other intellectual property rights in all logos, designs, text, images and other materials on our website are automatically owned by us (that means, without the provider giving us their permission first).
Because all content is owned by B at Home, no-one should ever copy, adapt, exploit or otherwise any of that content – save for downloading and temporarily storing one or more of our webpages to revisit or show to a friend.
